Terms and Conditions of Service
Effective Date: 10 August 2025
These Terms and Conditions of Service (“Terms”) govern your purchase and use of
access to the Cayman Fly Fishing Map (“Map”), a digital product offeredThese
Terms are entered into between you and RIPL COLLECTIVE LTD t/a Cayman Fly
Fishing, a company incorporated in England Number: 16638607 (“we”, “us”, or
“our”). (“we”, “us”, or “our”). By purchasing access to the Map, you agree to be bound
by these Terms. If you do not agree, do not proceed with the purchase.
1. Digital Product
The Map is a curated, view-only digital product providing information about
fishing locations, techniques, species, and other content related to fly and inshore
spin fishing in the Cayman Islands. No physical product will be delivered. The
information presented is intended to be used as a general guide to enhance your
recreational fishing experience and does not constitute professional or navigational
advice.
2. Access and Delivery
Upon successful payment, access is granted for 1 month (30 days) from the date of
purchase. After the access period ends, continued access will require a new manual
purchase. There is no automatic renewal.
. You must have a compatible device and an internet connection to access the Map.
We may limit the number of devices from which the Map can be accessed
concurrently. Access is typically granted immediately but may take up to 24 hours
in some cases. We reserve the right to revoke access if fraudulent activity or Terms
violations are detected. You will need to have a Google Account to view the Map
and access can be granted to your Gmail or other email as long as you link the email
address to a Google account
3. Payment, Pricing, and Access
All prices are listed in USD or GBP and are subject to change with prior notice.
Payment must be made in full at the time of purchase through our secure payment
gateway.
Access to the Map is granted for 30 days from the date of purchase. After this
period, access will expire unless you choose to manually purchase another 30-day
access period. There is no automatic renewal.
You are responsible for tracking your access period and making a new purchase if
you wish to maintain uninterrupted access. We are not responsible for any lapses in
access resulting from failure to manually renew.
We are not responsible for any additional fees charged by your bank or payment
provider.
4. Account & Security
Users must provide accurate registration details and maintain the confidentiality of
their login credentials. You are responsible for all activity under your account and
must notify us immediately of unauthorized use. We reserve the right to suspend or
terminate access to users who share login credentials or engage in unauthorized use.
We do not guarantee that account security measures will be completely effective
and you acknowledge that use of any online service carries inherent risks.
5. License and Use
You are granted a non-transferable, non-exclusive, personal license to access and
use the Map for your own recreational fishing purposes. Redistribution, resale,
sharing, copying, downloading, or creating derivative works from the Map is strictly
prohibited. Use of automated tools, bots, or scripts to access or extract content from
the Map is not allowed. You must not modify, adapt, translate, or reverse engineer
any part of the Map or attempt to bypass any technical measures used to restrict
access.
6. Refund Policy
Due to the digital nature of the product and the value provided upon access, all
purchases are final. No refunds or partial refunds will be issued. Refunds will not be
issued in cases of user error, dissatisfaction with the content, or inability to access
the Map due to outdated or incompatible devices or software. Refunds will also not
be issued due to changes in government regulations or fishing laws, including but
not limited to bans or restrictions that prevent certain individuals—such as non-
Caymanians—from engaging in fishing activities. Your use of the Map for
educational, research, or non-fishing planning purposes remains valid regardless of
such changes.
7. Accuracy and Liability
While we strive to provide accurate and up-to-date information, we make no
warranties regarding the completeness, reliability, or suitability of the content.
Fishing conditions, property boundaries, legal access, and environmental features
are subject to change. The Map is not a replacement for official government
publications, nautical charts, or local regulations. You must exercise judgment and
verify information independently before acting on any content found in the Map.
8. User Responsibilities
You are responsible for ensuring compliance with all local laws and regulations
while fishing in the Cayman Islands. Respect for protected areas, seasons, and
species is essential. You must independently verify whether access points, walking
routes, or parking areas identified in the Map remain publicly accessible. Some
routes or parking sites may transition to private property without notice. It is your
sole responsibility to determine the legality of accessing or parking at any given
location. We are not liable for any legal consequences or injuries that may occur
from using or following any route, path, or access point indicated in the Map.
Users must not use the Map or associated services to violate any laws, infringe on
intellectual property, or engage in unauthorized commercial use. Attempts to copy,
scrape, or automate access to the Map are strictly prohibited. Any user found
violating these responsibilities may have their access revoked without refund and
may be subject to legal action.
It is your sole responsibility to ensure that you are legally permitted to fish in the
Cayman Islands. This includes understanding and complying with any new or
existing regulations that may apply specifically to non-Caymanians, including
proposed or enacted fishing bans. Your purchase of the Map does not grant
permission to fish. If your legal status changes or government restrictions affect
your ability to fish (e.g., a ban on non-Caymanian fishing), this does not constitute
grounds for a refund. Continued access to the Map for non-fishing use remains
permitted.
9. Third-Party Content & Links
Our Map , or related company products and information, may contain links to
third-party websites or services. We do not control or endorse them and are not
liable for their content or performance. Your use of such third-party services is
solely at your own risk. We are not responsible for the accuracy, availability, or
reliability of content hosted by third parties, nor do we monitor their privacy
practices. It is your responsibility to review and accept the terms of any third-party
service before use.
10. Intellectual Property
All content, including text, graphics, icons, interactive features, and map data, is the
intellectual property of RIPL COLLECTIVE LTD and protected under applicable
copyright, trademark, and other laws. You may not copy, screenshot, modify,
distribute, sell, archive, or derive other content from the Map. Unauthorized use
may result in legal action. Use of our logos, branding elements, or any content for
promotional or commercial purposes without express written consent is prohibited.
11. Platform Changes
We reserve the right to migrate the Map and its associated services to a different
hosting platform or software provider at any time (e.g., transitioning from Google
My Maps to another mapping tool). In such cases, all reasonable efforts will be made
to ensure a smooth transition and continued access. Users will be notified in
advance of any major platform changes and provided with updated access
instructions as needed. Such transitions will not constitute grounds for a refund or
cancellation.
12. Termination
We reserve the right to suspend or terminate your access for non-payment, breach
of these Terms, or at our sole discretion. After termination, you will no longer have
access to the Map or any associated services or account data.
We are not obligated to issue partial, prorated, or full refunds in the event of service
termination resulting from the closure, sale, or transfer of the business or product.
Continued access beyond the notice period is not guaranteed.
In the event of an ownership change or business acquisition, we reserve the right to
assign or transfer all users, data, and rights under these Terms to the successor
entity. The successor may continue, modify, or terminate access to the Map in
accordance with its own terms and policies. You will be notified of any material
changes to the Terms or access management resulting from such a transfer.
Upon termination of your access for any reason, you must cease all use of the Map
and delete any stored, derived, or cached content from your devices or accounts.
Any remaining rights granted under these Terms will automatically be revoked
without further notice.
13. Disclaimer & Limitation of Liability
The Map is provided “as is” without warranties of any kind. We disclaim all
warranties, express or implied, including but not limited to accuracy, fitness for a
particular purpose, or non-infringement. To the maximum extent permitted by
law, our liability is limited to the amount you paid in the preceding 12 months. We
are not liable for injuries, legal consequences, or other damages resulting from use
of the Map, including, and not limited to, following walking paths or using parking
or access points identified therein.
We do not guarantee that access to the Map will be uninterrupted or error-free.
Scheduled maintenance, technical issues, or service transitions may cause
temporary unavailability. You acknowledge that digital services may be subject to
limitations, delays, and other problems inherent in the use of the internet and
electronic communications.
14. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, losses, or
legal fees arising from your use of the Map, violation of these Terms, or
infringement of any rights of a third party. This indemnity extends to your misuse
of any content derived from the Map, your breach of applicable laws, or the
consequences of inaccurate information entered into any third-party tools in
connection with the Map.
15. Age Requirement
You must be 18 years or older and legally capable of entering into binding contracts
to use this service. If you are under 18, a parent or legal guardian must purchase and
accept responsibility on your behalf. We reserve the right to request proof of age or
parental consent at any time.
16. Force Majeure
We will not be liable for any delay or failure in performance resulting from causes
beyond our reasonable control, including acts of God, power failures, natural
disasters, and government restrictions. In the event of a force majeure, we will make
reasonable efforts to restore service and notify affected users.
17. Electronic Communications
By using this service, you consent to receive communications from us
electronically. These communications include notices about your account and
information concerning or related to the service. You agree that such
communications satisfy any legal requirement that communications be in writing.
18. Entire Agreement and Severability
These Terms constitute the entire agreement between you and us regarding the
Map. If any provision of these Terms is held to be invalid or unenforceable, the
remaining provisions will remain in full force and effect. Any failure by us to
enforce any right or provision of these Terms will not constitute a waiver of such
right or provision.
19. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of the
United Kingdom. Any disputes arising from or in connection with these Terms shall
be subject to the exclusive jurisdiction of the courts of the United Kingdom.
20. Feedback
Any feedback, ideas, or suggestions you submit to us regarding the Map shall be
deemed non-confidential and may be used by us without any obligation or
compensation to you. We reserve the right to incorporate feedback into our services
as we see fit.
21. Export Compliance
You agree not to use or access the Map in violation of any applicable export laws or
regulations. You confirm you are not located in a country subject to embargo or
listed on any UK or international government sanctions list. It is your responsibility
to comply with local laws regarding access and usage.
